1. General Provisions
1.1. These Rules regulate the Company's main principles and procedures for the collection, processing and storage of personal data, on the basis of which the Company, as a data controller, processes the Client's personal data in the online store;
1.2. These Rules are intended for persons who use or intend to use the Goods and Services provided by the Company as specified in the Online Store;
1.3. Customers' personal data are processed in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR), the Law on Legal Protection of Personal Data and other legal acts;
1.4. All visitors to the Online Store, wishing or intending to purchase Goods and Services from the Company, as well as by using the Online Store, confirm that they have properly familiarised themselves with the Rules and agree that the Company may process the information they have provided (including personal data) to the extent necessary to ensure the Company's e-commerce and/or the management and functioning of the Online Store.
2. Principles of Personal Data Processing
The collected data is strictly protected and processed ensuring the right to privacy of each individual, and the requirements of personal data protection legislation are observed. The following Data Protection principles are followed when collecting and processing personal data, including:
2.1. Personal data is collected for specified and legitimate purposes.
2.2. Personal data is processed accurately and fairly.
2.3. Personal data is processed lawfully, i.e. only in cases where:
3.3.1. The Client consents to comply with the general e-commerce rules of the Company;
3.3.2. A contract is being concluded or performed where one of the parties is the client;
3.3.3. The Company is obliged to process personal data under the law
2.4. Personal data is accurate and, where necessary for the processing of personal data, continuously updated. Inaccurate or incomplete data must be corrected, supplemented, destroyed or its processing suspended;
2.5. Personal data is identical, adequate and only to the extent necessary for its collection and further processing;
2.6. Personal data is stored in a form that allows the identity of clients to be established for no longer than is necessary for the purposes for which such data was collected and processed;
2.7. Personal data is processed in a manner that ensures, through appropriate technical or organisational measures, adequate security of personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage.
1. Collection, Processing and Storage of Personal Data
The Client's personal data (name, surname, delivery address, phone number, email address and other information specified in the Online Store registration form) are collected and processed in order to:
1. process the Client's orders for Goods;
2. issue financial documents;
3. resolve issues related to the delivery or shipment of Goods;
4. fulfil other contractual obligations;
5. for communication purposes;
6. for direct marketing purposes
1.1. During registration in the Online Store, the Client must provide complete and accurate personal data.
1.2. When processing and storing the Client's personal data, the Company implements organisational and technical measures that ensure the protection of personal data against accidental or unlawful destruction, alteration, disclosure, as well as against any other unlawful processing.
1.3. The Company may use data not directly related to the Client's identity for statistical purposes, i.e. data about purchased Goods. Such statistical data will be collected and processed in a manner that does not allow the disclosure of the Client's identity or other personal data by which the identity of a person could be established.
2. Transfer of Personal Data to Third Parties
2.1. The Company reserves the right to transfer information to third parties:
- only for the purposes mentioned in Section 4 of these Rules;
- only in accordance with the procedure established by the laws of the Republic of Lithuania.
3. Legal Basis for Personal Data Processing
3.1. The Company has the right to obtain and process the Client's personal data when at least one of the following conditions is met:
6.1.2. The Client purchases Goods and Services from the Company's Online Store;
6.1.3. The Client gives consent to process personal data;
6.1.4. The processing of personal data is permitted on the basis of legal acts;
6.1.5. In pursuit of the Company's legitimate interests, such as, for example, filing claims in court, taking other legal actions to reduce or avoid losses.
3.2. If the Client refuses to provide personal data that is necessary for the conclusion and/or performance of a contract, or the provision of which is required by law or contract, the Company will be unable to provide services to the Client.
4. Submission of Information or Complaints
4.1. A Client who has permitted the processing of their personal data has the right to request the modification of personal data or the suspension of its processing, except for storage, where the data is processed in violation of the law;
4.2. Upon receiving a Client's request regarding the processing of personal data, the Company will provide the Client with a response no later than 30 calendar days from the date of the Client's inquiry. Only requests regarding personal data processing submitted in writing (by email at [email protected] or by post to J. Savickio g. 4-7, Vilnius) will be considered.
5. Personal Data Retention Periods
5.1. Personal data collected by the Company is stored in printed documents and/or in the Company's information systems in electronic format. Personal data is processed no longer than is necessary to achieve the purposes of data processing or no longer than required by clients and/or provided for by legal acts.
5.2. Although a client may cancel the contract and the Company's services before a previously set time, the Company is still required to retain the client's personal data due to possible future claims and legal proceedings until the retention periods expire;
5.3. The Company aims not to retain outdated or unnecessary information and to ensure that personal data and other information about clients is continuously updated, accurate and destroyed in a timely manner.
6. Client Rights
The Client has the right to:
6.1. Receive information about the personal data processed by the Company, where and how the personal data was collected and on what basis it is processed;
6.2. Contact the Company with a request to correct their personal data, suspend its processing, or destroy it, if the data is incorrect, incomplete or inaccurate, or if it is no longer necessary for the purposes for which it was collected. In such a case, the client must submit a request, upon receipt of which the Company will verify the information provided and take the necessary steps. It is very important to the Company that the personal data it holds is accurate and correct;
6.3. Contact the Company with a request to destroy personal data or suspend the processing of such personal data, except for storage – in the event that, upon reviewing their personal data, the person determines that the personal data is being processed unlawfully or unfairly;
6.4. Object to the processing of personal data where such data is being processed or intended to be processed for the purpose of direct marketing or on the grounds of a legitimate interest pursued by the Company or a third party to whom the personal data is provided;
6.5. Withdraw their consent to the processing of personal data for direct marketing purposes at any time;
6.6. A Client wishing to withdraw consent to the processing of personal data or wishing to have the processed personal data deleted must submit a free-form written request to the Company. The Company must provide the Client with a response or confirmation of the completion of these actions no later than 30 calendar days.
6.7. If the Client is concerned about the Company's actions (or inactions) that may not comply with these Rules or the requirements of legal acts, they may contact the Company and receive free assistance;
6.8. A person may exercise all of their rights as a client by contacting the Company by email at [email protected]
6.9. If the matter cannot be resolved with the Company, the client has the right to contact the State Data Protection Inspectorate, which is responsible for the supervision and control of acts regulating the protection of personal data.
7. Final Provisions
7.1. These Rules are governed by the law of the Republic of Lithuania and the European Union;
7.2. Clients may familiarise themselves with these Rules in the Online Store at https://iperku.lt/.
7.3. The Company has the right to unilaterally partially or fully amend or supplement these Rules at any time by notifying customers in the Online Store and at the specified email address.
7.4. Amendments or supplements to the Rules take effect from the date of their publication, i.e. from the date they are posted in the Online Store system.
7.5. If the Buyer does not agree with the new version of the Rules, the Client has the right to reject them in writing (by email at [email protected] or by post to MB Iperku J. Savickio 4-7, Vilnius), on the condition that the Buyer loses the right to use the Online Store services.
7.6. Cookies are used on the Online Store website. By continuing to browse, Clients agree to the necessary Cookies. They may also agree to other Cookies. The Client may withdraw their given consent at any time by changing their internet browser settings and deleting the stored Cookies. In some cases, refusing or deleting Cookies may slow down internet browsing speed, limit the functioning of certain features or block access to the Online Store website.
